Exton Advisors launches a “special situations” litigation financing service

Leading consulting firm pledges to support UK businesses

LONDON – Exton Advisors, a leading financial litigation advisory firm, is launching a unique range of “special situation” services designed to help businesses view their disputes in a whole new way. The move responds to growing economic uncertainty caused by the global pandemic and sees the firm create a range of advisory service lines designed to help businesses and their legal teams find the right financing products to support their litigation and unlock a potential working capital at a critical time.

Created in 2018, Exton Advisors is made up of consulting practitioners in litigation financing, law, insurance, insolvency and financial structuring. Responding to the rapid growth of litigation funds in the UK over the past few years, the firm was established to provide financial advisory services to in-house lawyers, many of whom need genuine advice to assess the growing range of financing options available. . Many corporate legal teams have significant levels of capital invested in pending litigation, but simply don’t know where to start when it comes to funding those cases or how transactions should be structured. Exton’s Special Situations Advisory Service aims to turn these disputes into assets, putting the working capital back into the business.

Comments from John Astill, Founder and Director: “Litigation financing is about to enter a golden age, but the reality is that the asset class remains opaque and complex. We have seen a number of recent judgments highlighting the danger businesses and their private practitioners face if transactions are not structured properly, including protection against adverse costs in relevant common law jurisdictions. We’re designed to simplify this complexity and help customers make informed choices.

While corporate legal teams take tentative steps to commit to specific funds, they currently have no way of comparing options or understanding the relative merits and risks locked in the funding agreement. They also rely heavily on their list of law firms for advice, many of which have limited relationships with the donor community. The Exton team provides them with an independent view of the entire market, which increasingly sees new and unknown entrants with significant capital to deploy.

Astill continues: “Working directly with one or two funders can lead to cookie-cutter solutions. As a result, corporate attorneys have historically relied on their private practitioners to help them organize funding for their critical litigation, but this doesn’t always make sense – litigators are appointed for their ability to show leadership. good side of a dispute, not their financial advice, and in some circumstances there is a risk that they may have competing interests.

The firm is now working with a number of UK companies and private firms on new mandates, many of which are emerging as a result of collective, post-Covid-19 complaints. While the independence and insight provided by the business is important, building trust is key.

Tom Steindler, director, concludes: “Now more than ever, the organizations we work with need a trusted partner to help them ease pressure on their balance sheets and realize the value of the assets stranded in their claims and indemnity portfolios . In many ways litigation finance is still a nascent force and we are keen to provide a true business finance advisory service to help companies expertly navigate the asset class and make the most of the opportunities. opportunities it offers; for us, it’s about simplifying and improving everyone’s experience.
